Many of our clients have suffered serious accidents. Others are dealing with severe illnesses. For many, returning to their pre-accident lives will not be possible for a long time, if ever. Many will need extensive lifelong assistance for medical care, rehabilitation, personal care, transportation and other needs.

At Romeo Pitaro Schneider Injury Lawyers, we know that being able to support yourself and your family is of vital importance, and part of your identity and self-worth. Being too injured or ill to support yourself physically or financially is devastating.

Insurance and disability benefits allow you to maintain your dignity and independence.

However, navigating your way through the process of getting those benefits can be difficult when you're already under stress from your personal injury, illness or recovery. And if the benefits offered are not enough to cover your needs, or are denied when you need them most, it may be almost as traumatic as the injury itself.

Types Of Benefits

If you are injured, the main kinds of benefits you may access are through private insurance or through the Canada Pension Plan (CPP).

Short-term disability generally covers up to six months off your job, though policies vary. At the end, you are eligible to come back to your job or a similar one.
Long-term disability usually covers up to age sixty-five if you are unable to do any work. If you recover, you may come back to a similar job.
CPP disability can be difficult to qualify for, as it generally requires you to be completely disabled and unable to work any job, including a job that is below your qualifications or in another location.

Denials

Some clients are told that they are not considered disabled, or that their particular injury or illness is not covered. Many force themselves to go back to work despite their disability and pain, and damage themselves further.

At our office, our lawyers will:

Examine your insurance policy and explain what benefits are available to you
Ensure that your benefits are not denied or delayed because of administrative errors
Explain terms such as own/any occupation, and determine whether you qualify as "disabled" according to your policy and your job
Help you with denials, determining why you have been denied, helping you through the appeals process with insurance, and representing you in court if necessary

THE BENEFITS PROCESS IN ONTARIO

Many of our clients who are injured or disabled are dealing with a lot of disruption in their lives. They may be juggling family, financial, physical and emotional difficulties as they try to recover or adapt to their injuries.

The last thing they need is to deal with lengthy insurance policies, confusing forms and unfamiliar language, or have to figure out what kind of documentation, medical and personal information to share. Knowing that missing deadlines, or putting in the wrong information, can delay or derail financial help that they need, adds more stress to an already stressful situation.

At Romeo Pitaro Schneider Injury Lawyers, we guide our clients through this process, helping to take the stress away.

Step By Step

Whatever kind of benefits you are getting, the general benefits process is usually the same.

Notify your employer about your inability to work.
Obtain the package of forms from your employer. This usually includes a package of forms asking for details about your employment and personal details, as well as medical forms for your doctor and other health care professionals in your case to complete.
Submit your form and documentation.
If your application is denied in full or in part, there is usually an internal process for appeal. The short-term and long-term benefits appeals are usually simpler than Canada Pension Plan benefits, which often require more detailed documentation and proof of disability.
If the appeal is unsatisfactory, you may want to put in a claim and negotiate for a satisfactory settlement, or go to court.
If you have recently become disabled, it's good to get advice before you hit roadblocks which may take away time and energy from your recovery or process of adaptation to your new circumstances.

If you have been denied, consulting an experienced lawyer can help you determine if you should appeal or not. Some denials are based on mistakes or misunderstandings about your condition, or missed deadlines.

We are willing to come in at any stage in the process and explain your options, and help you fight for the benefits you deserve.
