Wrongful death suit filed in death of teen

The family of a teenager who was struck and killed in a car accident in Mississauga is filing a lawsuit against the driver involved in the crash, as well as the municipality and the region as a whole. Ontario residents may be aware of the accident that killed a 15-year-old girl in December. The family has pointed to faulty streetlights at the intersection where the accident occurred as a partial cause for their daughter's death. They have filed a wrongful death suit in civil court. 

The family has acknowledged their daughter and her boyfriend were jaywalking the night of Dec. 2, 2016 when the accident happened. A driver travelling with the light reportedly struck the girl while travelling at some 70 km/h, which was the legal speed limit at the time of the crash. The girl was rushed to a local hospital where she later died, while the driver involved stayed at the scene and cooperated with police. He was not charged with a crime or traffic infraction. 

The girl's family pointed out that five streetlights were inoperable the night of the crash, a factor they say contributed to their daughter's death. They have named the City of Mississauga, the Region of Peel and the driver involved as the targets of their lawsuit. The suit is pending before the court. 

In fatal car accident cases, there are often many ways to assign blame. In this case, the family's wrongful death suit will be overseen by an Ontario civil court to determine its validity. If it is determined that the driver, the city and/or the region can be held accountable for the death of the teenage girl, the family may be entitled to damages awarded by the court.
