Scarborough: Two-Vehicle Crash Results In Fatality

A serious collision that occurred in Scarborough last week resulted in the death of a 26-year old man.

A Mazda 3 was turning at the intersection of Brimley Road and Elgar Avenue and struck a Chevy Malibu. According to the attending Toronto police constable, the car was traveling southbound at a high speed.

The cars collided and the driver of the Chevy crashed into a tree. The driver of the Chevy was pronounced dead at the scene. The driver of the Mazda was not injured.

Fault for the accident is yet to be determined. To facilitate the handling of insurance claims, insurance companies must determine who was at fault for an accident.

Once an individual reports an accident to his or her insurer, the insurer begins an investigation. The insurer must determine whether the driver was more than 25 per cent at-fault, in which case, the policyholder's premiums may be adjusted accordingly. Additionally, the insurer must also ascertain which property damage coverage is affected.

In order to determine fault, insurers use Fault Determination Rules, which:

· apply to over 40 different accident situations and which cover most road collision scenarios; and

· apply irrespective of weather conditions, point of impact or visibility

Once the rules have been applied, the insurer makes a decision on who is at fault. They make that determination by examining which scenario most closely resembles the actual accident.

If the insurer is unable to allocate fault, they fall back on the rules of negligence law.
