Lack of sleep and other factors can lead to driver fatigue

No drivers should operate a vehicle when they are tired or fatigued. This is especially true for truckers and drivers of commercial vehicles, as these vehicles are usually much larger and heavier than passenger cars and light trucks. When a commercial vehicle driver is tired or fatigued, serious accidents can occur that lead to innocent people being injured or killed. If you were injured in a truck accident, you might decide that the big rig driver should be held accountable for the accident. This can be done by seeking compensation in a civil lawsuit.

One factor that must be considered when you are deciding if you will pursue litigation is the cause of the fatigue the commercial trucker experienced. There are several different factors that can lead to driver fatigue. Work hours, too little sleep, ill health and driving habits are some of the problems that can cause a driver to get fatigued.

In the case of work factors, the trucker might be affected by tight scheduling, poor driving conditions, irregular work hours, night driving, long driving hours and having to complete duties that aren't driving-related. In each of these cases, factors that are beyond the driver's control are what caused the fatigue.

Not getting enough sleep, having certain medical conditions like sleep apnea and driving on familiar roads can also lead to driver fatigue. In this case, the trucker might be able to control some aspects of the fatigue. Examples of this would be if the trucker is prescribed medication. Failing to take doses at the appropriate times could lead to fatigue, which would be the trucker's fault.
